These terms govern your use of waxpaxstudio.com and every purchase you make from WaxPax. Read them. By browsing or buying, you agree to all of it, including the dispute-resolution section near the end.
WaxPax Studio LLC ("WaxPax", "we", "us") operates waxpaxstudio.com and the products, drops, and services offered through it (together, the "Service"). Access to the Service is conditioned on your acceptance of these Terms and of the policies referenced here, including our Privacy Policy and Returns & Refunds Policy.
These Terms apply to everyone who uses the Service: browsers, applicants, collectors, and buyers. If you do not agree to all of them, do not use the Service.
We may update or replace any part of these Terms by posting a revised version to this page. Continued use after a change means you accept it. Checking this page periodically is on you.
You must be at least the age of majority where you live, or have the consent of a parent or guardian who agrees to these Terms on your behalf. You may not use our products for any unlawful purpose or in violation of any law in your jurisdiction, including intellectual property and export laws.
WaxPax is an application-based studio. Applying to collect does not guarantee approval, access to any drop, or the right to purchase any specific piece. We may approve, decline, or revoke access at our discretion.
We reserve the right to refuse service to anyone, for any reason, at any time. Your content (excluding payment information) may be transferred unencrypted and may be adapted to technical requirements of connecting networks or devices. Payment information is always encrypted in transit.
You agree not to reproduce, duplicate, copy, sell, resell, scrape, or exploit any part of the Service, or any access to it, without our express written permission.
We work to keep the Service accurate, but we do not warrant that any content is complete, current, or error-free. Material is provided for general information and should not be your sole basis for a decision. Any reliance on it is at your own risk.
The Service may contain historical information that is, by nature, not current. We may change content at any time but have no obligation to update it.
WaxPax produces original, 1-of-1 works: art cards, prints, luxury toys, and other physical pieces. Each is unique. Because no two are identical, photographs, renders, and on-screen color are representations only. We cannot guarantee that your display reproduces a piece accurately, and minor variation in finish, foil, and texture is inherent to handmade and small-batch work.
Prices, descriptions, and availability may change at any time without notice. We may limit quantities, limit sales by person or region, and discontinue any product. Offers are void where prohibited. We may cancel an order if we identify a pricing or description error, including after the order is placed.
Some pieces are released through scheduled drops, waitlists, or raffles. Entry into a raffle or waitlist is not a purchase and does not guarantee allocation. Where a drop is oversubscribed, allocation may be determined by random draw or other criteria we set for that release.
If you are allocated a piece through a raffle or draw, your provided payment method may be charged for the winning allocation as described on the drop. We may void entries we reasonably believe were submitted through automation, duplicate accounts, or other circumvention of the rules.
Buying a physical piece transfers ownership of that physical object to you. It does not transfer copyright or any other intellectual property rights in the artwork. WaxPax and its artists retain all rights, title, and interest in the underlying art, designs, characters, names, marks, and digital assets, including the right to reproduce and display the work.
You may resell or transfer the physical piece you own. You may not reproduce the artwork, create derivatives, or use WaxPax marks or imagery for commercial purposes without our written permission.
Eligible pieces ship with a Certificate of Authenticity (COA) that carries a unique identifier and is verifiable through a public page on waxpaxstudio.com. The COA records the piece and its current registered owner.
The COA is a record of authenticity and provenance, not a security, investment, or guarantee of future value. Tampering with, forging, or misrepresenting a COA is prohibited and may result in revocation of the record and termination of access.
If you send us ideas, suggestions, or other materials ("submissions"), you agree we may use them without restriction, compensation, or any obligation of confidence. You are responsible for the submissions you make and represent that they do not violate anyone's rights.
We may, but are not obligated to, monitor, edit, or remove content we judge to be unlawful, infringing, abusive, or otherwise objectionable.
You may not use the Service or its content to:

The Service may link to, or rely on, third-party sites and tools we do not control, including payment, fulfillment, and analytics providers. We provide these on an "as is" and "as available" basis, without warranties, and we are not liable for them. Review the relevant third party's terms before you use it.
The Service and all products are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, WaxPax and its owners, employees, and suppliers will not be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits or data, arising from your use of the Service or any product. Some jurisdictions do not allow these limitations, in which case our liability is limited to the greatest extent the law allows.
You agree to indemnify and hold harmless WaxPax Studio LLC and its owners, employees, agents, and suppliers from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or third-party right.
These Terms remain in effect until terminated by either you or us. You may terminate by ceasing to use the Service. We may terminate your access at any time if you fail, or we suspect you have failed, to comply with these Terms. Obligations and liabilities incurred before termination survive it.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. You agree that the courts located in Orange County, California have exclusive jurisdiction over disputes not subject to arbitration below.
We would rather solve a problem than litigate one. Before starting any formal proceeding, contact us at studio@waxpaxstudio.com with a short written description of the dispute and your contact details. Both sides agree to try in good faith to resolve it directly.
If a dispute is not resolved, it may be required to proceed by binding individual arbitration seated in Orange County, California, and you and WaxPax agree to waive class or representative proceedings, except where prohibited by law. Claims involving intellectual property and small-claims matters are excluded.
Nothing in this section limits any right you cannot waive under applicable law, including the right to bring qualifying claims in small-claims court or to seek relief from a government agency.
You can review the most current version of these Terms on this page at any time. We reserve the right to update or replace any part of them. It is your responsibility to check for changes; continued use of the Service means you accept them.
